Mindef's appeals against Ting Choon Meng and the current and former editors of The Online Citizen will be heard in the Court of Appeal tomorrow, Court 9A of the Supreme Court at 2.30 p.m.. The coram comprises Chief Justice Sundaresh Menon, JA Andrew Phang, and JA Chao Hick Tin. The case involves an important question of whether or not the Ministry of Defence falls under the definition of "persons" under the Protection from Harassment Act 2015, so that it can take advantage of s15 of that Act. Apart from its impact on online speech, the case also has broader implications on whether and the extent to which the Government can take advantage of statutes although not expressly named in them. I'm acting as counsel in CA 26/2016, and the fourth Respondent in CA 27/2016.
