I have joined What To Eat Delivery for a month as their salesperson (For legal issue you may want to name the company as "Dinosaur Delivery" as they are represented by Dinosaur)
This is what happened:
The company issued me an employment contract which states for every restaurant and hawker we bring on board, we will be given $50 as commission.
There is a particular clause in the contract which is kind of unreasonable that states that we have to at least bring 10 restaurants and 10 hawker per month, anything less we will not be paid commission for all the restaurant and hawker. I mean what if we hit 9 restaurants and 10 hawkers, then all will not be paid because we are lack of a restaurant? I believe this clause is there to take advantage of such situation.
Anyway I started approached hawkers and restaurants and at the end of the month, I have 10 restaurants and 25 hawkers which fulfilled the "at least 10 restaurants and 10 hawker" clause. I am able to do that because I have work outside my working hour, went out to look for restaurants after my official working hour as well as on the weekend.
As for my colleague, she had bought 10 restaurants and 10 hawker on board but there are 4 restaurants of a same group whom she bought in the previous month said that they will not be able to commit temporary for some matters, so my boss said that this 4 restaurants has to be deducted from her current month sales which resulting in her not fulfilling the clause and not being paid any commission. Aside from that, my boss has demanded that she have to bring in another 4 restaurant to cover that 4 restaurants which mean she will have to look for at least 14 restaurants next month but will only be paid for 10 of them.
On 2 December, he suddenly came out and told us that all hawkers that we have brought in will not be paid any commission which meant my 25 hawkers will not be paid a single cent. This annoyed me and I resigned on the spot. Our basic is already very low at $1600 with transportation for work purpose to be paid by ourselves and he is trying to eat up our commission we earned using our blood and sweat.
During the pay day on 7 December which I am no longer in the company, I received my basic pay with no commission at all, not even for the restaurant. All my commission worth $1750 was unpaid. During my time there I have heard my colleagues telling me that a lot of restaurants who she had brought in previously have called her up frequently to chased for their payment so most likely this company is rolling using the restaurant money. I am quite confident that they are financial situation is in trouble. I text the boss about my payment issue but he refuse to send me my pay slip and challenge me to go to the MOM.
